(Querist) 19 April 2012 This query is : Resolved
I, Karan Bhateja, live in Rajsthan. My grandfather & grandmother has died & my mother and father has seperated leglly i.e. divorced. I & my younger brother lives with our mother. I want to claim on my grandfather`s property (home). my father is the only son of my grands but 6 daughters among my father.
please guide me & compliment as well about that - my father can live/ stay there after it comes to us or me & my brother?
How should i proceed for it in civil court or to any lawyer?
I have no documents of that property & don`t know as well where it is.

since your garnd parents died intestae the self acquired property of your grandfather will be distributed among his legal heirs namely your father and his 6 sisters . you dont have any share in said property

So far as dealing with the self acquired property of your grand-parents is concerned, the same has very well been defined by sethi but nothing has been told about their ancestral properties.

You and your brother are duly co-sharers in the ancestral properties, if any left by your grand-parents and you both can even get partition to that property.

So far as details of those properties is concerned, you shall have to obtain the desired details from your family members and then can obtain certified copies of the title deeds from the concerned offices of registrar.
