Ancestral property

My grand father have some ancestral and some self acquired property,he disposed off all the property in the name of two of his sons, left one son penniless, i want to know that what option have that (penniless)son now. please help me.

File a suit for partition and injunction.

Zunaid,
Believe the penniless son is your father:
& governed as per Hindu Law,

Your father can claim his right of ancestral property only.
Self acq property, he can deal with as he like.
issue notice that such disposal is not binding , ask for partition, .
If ur gr father do not agree, your father have to go to court for his rt.

To me son discorded does not have any right to sue against "property self acquired" but certainly he can sue for " ancestral property
forming part of coparcenary",in other wards property you are calling ancestral must be traced to have been acquired by your great1 great2 grand father[in other words it must have come in the hands of your grand father from his grand father vai his father].

First and foremost we have to know whether the question relates to a Hindu or a Muslim (from the name of the querist it appears it relates to a Muslim).

And there is no concept of any ancestral property among MUSLIMS.
