Central civil services (cca) rules, 1965

1. An inquiry under Rule 14 was in progress.

2. On, his retirement the Inquiring Authority requested the Disciplinary Authority to relieve him from the responsibility.

3. Meanwhile, the Disciplinary Authority took long leave and based on his request, the competent authority appointed a new Disciplinary Authority.
4. Can the new Disciplinary Authority appoint a new Inquiring Authority?
5. Can the inquiry be continued from the stage where the previous inquiring authority left it.

No need to comment on points 1 & 3. Answers to your quries at points 2, 4 & 5 are as under:

2) Depends upon the discretion of the Disciplinary Authority to accept or not to accept the request of the I.O. for change on his retirement. I.O. can continue with the inquiry proceedings till completion.

4) The disciplinary authority can change the I.O. at any stage for reasons recorded in writing.

5) New Inquiry Officer can continue proceedings from the stage the previous I.O. left. He has also the discretion to start inquiry proceedings from the initial or intermediary stage, if considered proper or having not been satisfied with the existing inquiry process.
