File a suit for eviction on the ground of reasonable requirement and in default of paying rent.

If WS is not filed in the present suit then you can raise counter claim in the same suit on the points mentioned above.
Kiran Kumar (Expert) 19 October 2011
follow the provisions of rent act as applicable to your state.
H. S. Thukral (Expert) 19 October 2011
the nature of eviction case shall depend upon the amount of rent the tenant is paying. It can be an eviction petition under rent control laws or an ejection suit under the TP Act.

need to do as advised.
Rupam Ghosh (Expert) 20 October 2011
firstly if your client is not heard in the injunction petition and you have grounds also for the eviction so you can challenge that order. Also you can file a suit for eviction on the grounds that he is a defaulter and also you can show your bonafide requirement.
