Querist : Anonymous (Querist) 22 September 2011 This query is : Resolved 
miss use of a signed white paper, which law of section application. and he created the signed paper has a willdeed issued.


one person has misuse his father empty signed paper and he created a willdeed on that empty paper, in the cross examination the person said that he only typed the matter in the willdeed.

its a valid will, tell me plz which section and law applicable for above matter suggest me. or any section for that tell me

If you prove in the court that will was typed on a plain paper pre signed by the alleged testator,you shall succeed as the court will not accept such a paper to be a validly made will. Try the witnesses to cross and admit that the will was not signed by the testator before them,the will fall for want of attestation.

It is not valid WILL, but it is to be proved before court for cancellation.

only if the signature is forged then only it amount to fabrication of document. Cheating will not arise. One cannot prove the the document is a blank paper it was filled-up later. That to father's will deed. unless father come alive to say
