Review of order

Querist : Anonymous (Querist) 15 September 2011 This query is : Resolved

Dear All

Can consumer forum review its own order when there is error apparent on the face of record?

R.Ramachandran (Expert) 15 September 2011
The power of review or recall is vested only with the National Commission. Neither the District Forum nor the State Commission can either review or recall their own order.

Having said this, the fact situation given by you does not fall under either "Review" or "Recall". But it falls under the category of Rectification of Mistake. If the error is apparent on the face of the record, then all the Forums which passed the order is capable of rectifying the mistake apparent on the face of the record.

Clerical mistakes can always be corrected by the forum.
Shailesh Kr. Shah (Expert) 15 September 2011
As per Section 22(2) of the Consumer Protection Act, "Without prejudice to the provisions contained in sub-section (1), the National Commission shall have the power to review any order made by it, when there is an error apparent on the face of record.

Thanks to all of you
Can I have citation to show that errors apparent on the record can be rectified by forum which passed the order?
Shailesh Kr. Shah (Expert) 18 September 2011
There should be no citation about apparently correction of records.
