yes he can. but the general body must have elect or nominate him as secretary. The bye laws should not be a bar to his appointment.

Under the model bye laws of Housing Socieites in Maharashtra Secretary is elected by the memebrs of the MC from amongst them. Hence a memebr of the society who is coopted by the MC in a vacancy that has arisen can be elected as secretary by the MC. if another elected memeber is also willing to hold the office, then the MC will hold voting and elect from amongst the coopted memebr /elected memebr.
