Fixation

if there is a live broadcast and it is simultaneously recorded but later all recordings are destroyed will subsequent use of the material by anyone else be a copyright violation?

will the requirement of fixation for the purpose of copyright be fulfilled in such a case?

Copyrighted work may become part of the public domain and may be used, copied or distributed ONLY AFTER the prescribed copyright period expires. Otherwise, specific permission is required from the person holding copy right, if desired to be used.

the issue is regarding whether a copyright has come into place or not

If it is been registered under copyright act then it comes under the act otherwise not.
