Legal requirement of engaging a lawyer

Dear Sir,
I am in litigation with an individual who is also my office colleague in a cheque bouncing case. I engaged a lawyer to file the case under 138 NIA. But my lawyer does not show the required interest in pursuing the case. Kindly advise if I can fight my case before the MM without a lawyer. I found the almost all the lawyers are greedy rather than getting the justice to the client. Thanking you very much,

Dear Mr. Rohilla,

I do not know how to answer your query.

I cannot say, engage another lawyer, since according to you almost all the lawyers are greedy.

If I say you fight the case yourself and if any complications arise, later on if you yourself feel that it would be better to engage a lawyer, quite possibly becuase of the complication, the lawyer may demand more. Again there is every possibility that I may get exposed to the charged that only in order to favour some unknown Advocate, I advised you to handle the case yourself!

Damned if I say yes and damned if I say no.

So, I think, you are the best judge to decide. Afterall, if you fight your own case, you need not spend any money. Further more, you would have successfully avoided a greedy advocate. The only draw back would be that you would not be having anybody to blame.

you are at liberty to argue your own case .
if case is going on for long time lawyer is going to charge you fees . you ought to arrive at an arrangement with your lawyer wherein fees per date can be fixed

You should keep faith in your lawyer, justice will come but it will take time. You can fight your own case with the permission of court but how you will do this i am in doubt it all looks so easy when your advocate is doing but when you will do it at your own then you will realise that its better to engage an advocate.

The lawyer is providing legal services to you and for this he is charging a fee, how you can say he is greedy. Are you doing your job without getting any remuneration from your employer. Don't you expect money form your employer. If the lawyer is charging fee he is greedy as per your views.

It was your need and you went to him, he was not the person who came to you.


I am completely agree with the views of Mr. Ramchandran- that you would not be having anybody to blame

Thanks a lot my dear advocate friends,
I think you would have read my brain that I am not getting satisfactory assistance from my lawyers. In fact I am in litigation in Delhi High Court for a specific performance case in a property deal for more than 5 years. Firstly I am duped by the seller of 9 lakhs by him and secondly the desired progress is just not there. I do not know if it can be given a judgement in next five years. I need not tell you how much I would have already spent in this case.
I wrote to you just to guide me if I can fight my case in the court of my own without a advocate for a cheque bouncing case. Because just for an amount of Rs.70000 I have already paid advocate fee of Rs.12000 when a summon could not yet been serviced by my lawyer. Sorry for if somebody is hurt by calling all the advocates greedy. Thanks for your views once again, sir

I am confused what and how to reply. Once you have come to conclusion that almost all advocates are greedy then why to ask the solution of your problems from lawyers designated as experts in this section.

You might have knowledge that all expert in this site are lawyers and all pay they valuable time for general people free of cost for redressal of their legal problems.
