property dispute

(Querist) 27 January 2011 This query is : Resolved 
My late father has 4 sons. We 4 brothers are living together so far. Now are children are grown up and therefore we need extension of the house.
Do you advise that I should construct additional room first and then make partition OR we should first have demarcation of property/house and then construct the room?
I will be highly obliged if you kindly advise us.

Though if you add anything in the joint property rom your own fund you later lay clam on it at the time of actual partition, to remove any dispute it is better you wait till partition by metes and bounds takes place.

Suggested : first get the property demarked and make an MOU regarding partition thereafter take any step in your portion

You must first get property demarcated, then must construct according to your choice.

Mr. Burmans statement is correct. If you need the room urgently, you make agreement or MOU with other family members for repaying the expenses for the room, if the room was not allotted to your share, or the room has been allotted to your share at the time of partition. and immediately you may registered it.

Partition first and then construct. Otherwise the portion developed by you may go into the common hotch potch of the joint property.
