Procedure differs from state to state. f you are from bengal then you have file application under Act 39 before the court of district delegate. So get in touch with an advocate.

First you will to file an application before the concerned Tahasildar to get the succession certificate, after that village accountant or concerned person will make an enquiry and issue the succession certificate.

Succession Certificate is issued for only monitory amount. In case, it is less than Rs. 5000/-, it can be obtained from the Collector Office but is this called Varisan Certificate i.e. legal heirs certificate, it contains the name of legal heirs of the deceased and valid up to Rs. 5000/- only But for above amount you have to obtain succession certificate from civil Court of competent jurisdiction
