Discussing about allimony is legal or illegal

Guest (Querist) 10 December 2010 This query is : Resolved
My friend is having problem. Her husband wants a mutual divorce, but my friend does not want divorce, but her husband is not ready to reconcile with her at all. So now my friend wants allimony from her husband.

1) So is mutual divorce can she get allimony ???

2) She wants to discuss allimony amount with her husband, but she is afraid that her husband might record all that, and say to court that how greedy his wife is, and therefore he won't give a single rupee. So my question is discussing about allimony is legal or illegal ???

3) She is not working, and she has no child so can she ask for permanent allimony ?????

4) And is which case allimony or permanent allimony or maintenance is not granted to women by court. [note- My friend is not into adultry, she was very much committed to her husband]

1. Yes but only such amount which is mutually agreed.
2.No, it is absolutely legal and very much reconised by court as well.
3.Yes, very much.
4. Only when it is proved that the wife is working and earning handsome income or left her matrimoniial home on her own will.

Thankyou so much Dev sir. But sir want to ask

1) If the wife doesn't agree with the allimony amount, and husband doesn't cooperate wife then what happens ????

4) If the wife is working then she doesn't get allimony ???? But i have heard that filmstars and working women who are rich enough also gets allimony and got allimony. So what is that case ????

5) And if is ready to join her husband but due to her inlaws and husband ill behaviour she is not able to do so,and is forced to stay deserted out from her matrimonial house, still can court say that the wife herself left her matrimonial house & disapprove her allimony ???

1. Then compromise fails and the wife will hae to file case claimin maintenance and alimony.
4. That is on compromise only.
5.no then the excuse is valid.
