Non payment of arrears of Wage Revision.

In 2006, Hindustan Copper Ltd. revised the Pay scale of their employees from 01.01.1997 and made payments of arrears to all on roll or retired/resigned/expired, but thousands of employees, who opted voluntary retirement, have not been paid. Neither they are paid their arrears nor they are being informed the reasons for such non-payment. Managerment is going their own way to eat away crores of rupees payable to such VRS employees. Some of the employees filed writ petitions, but it is very lengthy proces. RTI failed to get any inormation on the subject, as the management beat about the bush and does not part with the answers to the queries. All affected are above 65 years of age and have meagre resources to chase the management legally. Would some NGO or people friendly organisation come to help the hapless senior citizens go get their arrears. Thanks.

The employees covered under the industrial Act can directly approached the Authority appointed by the appropriate government exercising powers of appropriate government for recovery of arrears, in case there exist no dispute for their entitlement under revised pay scale under Section 33-C(1) of the Act. Generally Labour Commissioner, Deputy Labour Commissioner of specified area or Assistant Labour Commissioner of specified area are notified as Authority. In case of other employees, only remedy is to file writ petition. Even workman can also file writ petition.

Mr. Anonymous! Though I have full sympathy towards your genuine problem but I am sorry to point out that no any voluntary organization is seen fighting for such a noble cause as of you. It is better to form an organization of you affected persons and then authorize either of you to look after the day to day proceeding of the case by engaging a senior lawyer for that purpose. Writ is the only effective and fast remedy in your case.

I fully support Makkadji's pragmatic opinion. But the ground reality is, the same has miserably failed when Bank employees filed a case to restore back their arrears amount while the government deducted 2.8 times of their gross pay as on Nov 2007 to meet out the pension corpus.

My heartfelt thanks to all who felt concerned about the plight of Senior Citizens, who are not being paid arrears of Wage Revision due to them for the last about 4 years. This is the pity state of affairs of a Public Sector Undertaking i.e Hindustan Copper Limited, under the control of Ministry of Mines.

Forming an Organization of affected employees is not that easy because they are scattered all over India and contacting them is very difficult and management is taking benefit of this weakness. But those who are alive to the cause are doing their best by filing Writ Petitions or taking shelter of the RTI in their own way.

This is shameless on the part of Govt. of India, particularly the Ministry of Mines and Hindustan Copper Ltd, which otherwise boasts of being well-wishers of the Senior Citizens. The writer was an Executive with Hindustan Copper Ltd., but this issue relates to all hundreds and hundreds of Workmen and Executives. It is merely a high handedness of Hindustan Copper Ltd. and ultimately justice will be to our side only. Thanks once more.
