advice on 498A

Hi Group,


Can you assist me? My wife and her family has falsely made a FIR U/S 498A, 323, 3/4DP act. In that she has mentioned a big amount of money which has been shown to be given to my family as a dowry. But she is absolutely telling a lie. My marriage was a simple marriage. Is there any way to ask for the authenticity of the amount shown as the dowry from the IT Dept .

Yes. You can summon the IT dept to show that the said sum has not been accounted for. But how will it help you.? Just because that amount is not shown in the accounts,it will not be presumed that it was not given to you by them. On the other hand you must prepare grounds to prove that they did not have the capacity or means to pay such a large amount as dowry. that alone will do a lot of help to you.

Yes. That apart you could also file complaint against her and her father under Dowry Prohibition Act as both giving and taking of dowry are offence.
