what is cause of action as per order 23 rule 1 to file fresh suit on the same cause of action with out getting the liberty to file the same.

can a suit be dismissed on this objection?

If liberty is not given to file the fresh suit on the same cause of action,the subsequent suit is barred on the same cause of action.A suit can be dismissed on this objection. It is valid.
