hi my wife stays in usa from past 7 yrs now she is love with someone else i wnat divorce i cant go there and she cant come here or may be doe not wnat to how shoud i get divorce.please advice.

u file a divorce petition, esp on the ground of desertion, u may get ex parte divorce.

few HCs have even allowed divorce by Mutual consent where the power of attorney for a party has been allowed to appear on behalf of consenting party.

U may file for divorce in India in the court in whose territorial jurisdiction the marriage took place or where U last resided together.

If your wife is also willing to give divorce, both of you can file a consent petition for Divorce. Your wife can be represented through a Power of Attorney Holder. If consent petition is not possible, file a petition on the ground if desertion, adultary etc. The Summons of the Petition can be served to your wife through Indian Emmbesy in USA. You have to obtain appropriate Order from the family Court.
