Difference between working hours and extra over time

Hi,

One of my friend ask me that in Company act 1948, sec 63 specify that total working hours are for 9 hours in a day, when I see and found that this section relates to extra over time. so question arises in my mind is that:
Kindly specify that what is working hours for a young man in any organization including BPO industries.

As SPECIFIED IN STANDING ORDER, OR SAY WHATEVER ARE NO. OF HRS HE WORKS REGULARLY, or in his Appointment letter.

Suppose a workman duty hrs are 9am -5pm with 30 mts rest interval
7:30 is his daily working hrs
If he exceed it, he will be paid extra time, till he complete say 9hrs a day, and overtime, ie Double the wages when he exceed 9 hrs a day, or 45 hrs a week.

usually it is decided in settlement for wags during collective bargaining, as per ID. signed by union & mgm

If an employee is put to duty beyond the prescribed working hours that is overtime, i.e. in excess of the prescribed working hours.

As per the Factories Act -1948, Maximum working hours per day is

8 hrs + 2 hrs Overtime = 10 hours & 48 hrs in a week.

Overtime is 2 hours/day and not exceeding 12 hours/week and 50 hours in a quarter.

But those in management carry a responsibility of 24 hours ,i think.Any one can correct me if my notion is wrong.

Agreeing with M.r Shroff, the number of prescribed working hours per week are 48 hours. ( there can be a settlement on lesser working hours between the workmen and the employer) The working hrs can be so adjusted considering the weekly off of one or two days that the same don't exceed 9 hours per day and 48 hours a week. There can be a spread over of 11 hours/ day (providing a break in between two sessions) but actual working hours are not to exceed 9 per day. As far as overtime is concerned Mr. Shorff has given a correct example. Overtime is at the double rate only after 48 hours. suppose a establishment has 39 hours of working per week and total extra working of an employee beyond 39 hours is 12 hours in a week then for the first 9 hours i.e. upto 48 hours he will be paid normal overtime rate as agreed upon and for next three hours he shall be paid double rate.

Hi all members,

Happy New Yew Year 2012,

I have querry regarding purchasing of flat,

I have purchased a flat and also received possession letters. But following are querries:-

a) In agreement commencement certificate quoted is not matching with completion certificate.
b) Address/survey/hissa No. quoted in agreement is not matching in completion certificate as well as in Property tax & electricity bill.
c) I received Xerox copy of completion certificate.
d) Sale deed not being done by builder. Is it necessary at the time of sale of flat.

Kindly advise on these points.
