Respected members, please let me know if a society member can name all her children as associate members. Thanks in advance
Dr J C Vashista (Expert) 03 September 2016
Yes, the member can include his/her children as "co-sharer" and co-member, however, voting rights shall remain with first member.
Hemant Agarwal (Expert) 03 September 2016
Subject to MCS Act & Rules:

1. "IF" the children/s name do not appear in the "Sale Agreement" of the Flat, THEN the children CANNOT be named as "Associate member", for ANY purposes.

2. IT would be illegal for the Society, to make the children/s as "Associate member", for ANY purposes, if the Children/s are NOT "co-owners", of the Flat.

Keep Smiling .... Hemant Agarwal
