E1 forms

(Querist) 03 March 2012 This query is : Resolved
IN ANDHRA PRADESH ALL THE DEALERS ARE SUPPLYING E1 FORMS WHICH ARE PRE PRINTED IN STATIONERY SHOPS AND GETTING THEM SEALED BY CONCERNED CTOs. wHERE AS IN KARNATAKA E1 FORMS ARE GOVERNMENT PRINTED. IF WE SUBMIT ANDHRA PRADESH E1 FORMS IN KARNATAKA STATE DURING THE COURSE OF ASSESSMENT, KVAT AUTHORITIES ARE QUESTIONING THE GENUINETY OF THE E1 FORMS. HOW WE CAN CLARIFY THE GENUINETY OF OUR A.P.E1 FORMS.

Yes. clarify from the concerned authorities. These are statutory requirements and different governmetns have their own policies.

There might be some other alternative which you need to find out from the concerned department.

As in andhra official forms are not distributed so there is no way to satisfy Karnatka authorities except by bringing a notification from Andhra State in that regard.

In my opinion, until the the E1 form so submitted by A.P. dealers to Karnataka dealers in course of business conform to the format prescribed under A.P. rules and duly filled in and signed by the appropriate authority under seal and signature is valid in law and in case of any doubt on their genuineness, the accepting officer is free to directly seek clarification on the same from the issuing authority in A.P. .

There is no such requirement under the CST Act that E-1 form must be printed by the State Govt since this form is not marked with seal of the authority as in the case of C/F Forms. The CST Rule 12(4) requires that the this form must be in the prescribed form and no further reuirement under the CST Rules. Pl go through the fomrat of E-1 Form and C/F Form there is a specific difference. So the Assessing Authority should know that there is no requirement that this form should be printed/issued by the State.
