Bank not responding

(Querist) 09 February 2020 This query is : Resolved
Sir, We have won a case against Bank regarding non disclosure of pending case at the time of appointment. The Hon;ble High Court clearly ordered the Bank to set aside the termination order and reconsider the matter and give a fresh reasoned order. But, Bank said that it reconsidered the issue and felt that termination is correct. It clearly is violation of Indian Judiciary by the Bank officials. So, we filed writ again in the Hon'ble High court against the Bank. But, Bank is not filing the counter. The Bank lawyer is saying that he has not received any orders or instructions to proceed further in the case. Now, What should we do?? Please suggest. Its been 10 years since I lost the Job and its been 3 years since we filed second writ in the Hon'ble High court after winning the case in the first writ petition after 7 years of filing.

As the matter is sub-judice before Hon'ble High Court, its verdict is required to be obtained. Request high court to decide the writ at the earliest as bank is not filing its written statement despite of providing ample opportunity.

Though I am convinced with the subsequent order of the banker in legal sense.

What is the verdict/ directions passed by Hon'ble High Court has to be considered?
What is the opinion and advise of the lawyer engaged / paid by you, who is well aware about the case, an able, competent and intelligent enough to satisfy your queries ?
However, if you have lost faith in your lawyer it is better to change him/ her immediately and instead of waiting / following the advise/ obligation of experts on this platform based on limited facts posted by you, it is advisable to consult and engage another local prudent lawyer for professional guidance and necessary proceeding.

As the criminal case is still pending against you, no question arises to entangle the complainant in new case right now.
T. Kalaiselvan, Advocate (Expert) 21 February 2020
In the next date of haring you may insist and put pressure on court about the dilatory tactics adopted by the bank in order to cause inordinate delay and more and more hardships to you, therefore to decide about the matter by setting the bank as exparte.
You can discuss with your advocate on this and proceed.
