Sir,
My husband has said to almost every one in our locality that i am mentally unfit.And i jump through windows in the nights & i try to kill myself wth knife,he simply degraded me everywhere,actual his intention is to end our relation and marry somebody else.
Can I file the defamation suit against him.
My husband told us different caste at the time of marriage which is same as our & same is to his mothere's father's caste.
But later after marriage we came to know that he belongs to a different caste as he has adpoted the caste of his materal grandfather.Can I fill the suit for cheating against him
I am now also fed up with him as he has degraded me everywere.

i hope that husband and wife each against or any one against could not file defamation but you can claim compensation. as per law defamation could not come under wedlock.

You can surely file a criminal complaint for defamation.
It is advisable to go for a mutual divorce as both of you are not desirous of living together.

Sit and sort things out, if you both cannot live with each other, better file for divorce by mutual consent.

it appears your husband wants a divorce.filing case for defamation will worsent the issue . go for divorce by mutual consent . resolve all issues

All the experts have adivced to go for a mutual divorce,which is the correct thing.But if what you have mentioned is true,then file 498A and DV ACt to teach him a lesson.In every reply initially I try convience to go for a councelling,but after going through your query I felt my answer is correct.

Married 5 year back as per Muslim rituals (both being Muslim Sunni,arranged marriage Mehar Paid at the time of Nika),
Have baby boy of 1.6 years,
Husband abruptly stopped communication from lost 6 months; neither came to c me as I was at my parental home.
Now he is saying I have divorced you, as he say he has send Talaq through Registered post to my parental address to me & my father, as we were out of station so could not receive the same.
Also he is saying I have published in daily newspaper, but we did not have any information about it.
The allegation which my husband’s is putting is that I am not mental fit that too he is saying after 5 years of marriage & 2 years of engagement.
Now my husband is giving some baseless allegation which has never happened.

why do you keep on repeating same questios again and again .
clim maintenace from your husband ,for your self and child . safegaurd your finacial interests . dont waste time in filing cases

That gentlemen spoiled my life for none of my fault,I will definitely file maintenance suit against him,But i wan to teach him a lesson why he said in public that she is Mentally ill he has spoiled my all social life,all people will give a thought before talking with me or sharing anything with me and will have a look at different angle at me.
Sir,that i wan to file a Defamation suit ,so that in future anybody wont say absurd against a normal human being for his own vested interest.That is why i wan to file defamation suit & my query is whether it is maintainable or not & success rate.

If some body is blaming you-
1) That you are mentally unfit- so you have to prove with evidence that you are so blamed.
2) Than you have to prove that you are not mentally unfit.
LAW IS DOUBLE EDGED SWORD, SO TAKE CARE.

As advised i applied of maintenance suit for baby & myself what other suit i can file against the husband.
