Withdraw of names

civil suit was filed against 4 defendants and summons issued but could not be served. Now I want to remove names of 3 defendants from case and also want to change the petition. Is is possible.

As the summons could not be served to any of the defendants, you can withdraw the present suit and refile fresh suit with all the changes/amendments you want to do in the present plaint and memo of parties.

Summons may not have been served fo many reasons like change of address or reasons like absconding etc. You could publish an News Paper Advt with the Consent of Court.You need not with draw or modify the Petition which would be a waste of time and money for you. The Persons who had not served with summons would be treated as Ex Party for their non appearance after the News Paper Advt. Do not take hasty decisions and proceed calmly with the guidance of your Advocate.

You could. also file your additional grievances by filing the same as additional Petition in the same suit. Discuss with your Advocate

You can take steps for service of summons through newspaper advertisement as adviced above Further for change in petition you can file amendment application to amend the petition.

@ Ms. Kaur,
Instead of raising finger on the expert, you could better have asked your own lawyer and had there been any doubt in his advice, you would have been justified to raise your doubt here for clarification sake.

If your query is of doubtful nature the experts can ask question from you. Experts are not rendering charity service just to solve the academic questions, but the real problems of the persons encountering such problems in real life.

Anybody can easily guess that you had been raising only academic queries having no concern of yours with the problem.
