What is the actual time limit for charge sheet

hello respected lawyer sirs,i am from tamilnadu. one of my friend who was a tamilnadu state goverment school teacher received a eve teasing case by a night watch woman. the actual fact is the night watch woman was come to school at day time with out any legal rules. the head master and some of the teachers supported her. there is no written orders for that woman to come to school day time by any educational officers still now.. when my friend asked her not to come at day because u r a night watch woman.she was motivated by head master and some teachers at filed a case on december 17'2014 in local police station. the case filed in IPC 354 A (1) .they indicated the word sexually coloured remarks. but my friend approached local magistrate and got unconditional bail. but now he is suspend from his job temperorily from january'7 2015 by the education department due to this false case. after that there is no action by that woman still now. my question is (1)what is the actual time limit to file charge sheet? (2)if they are not file charge sheet with in the time period what will happen ?(3)is any rules and regulations to appoint a woman as a night watch woman in a goverment school at tamil nadu? you people please rectify my doubts. plz thanking you

There is no time limit for filing charge sheet. That 90 days time is for those accused in custody who in absence of filing charge sheet within 90 may get bail as a matter of right.
If you want to expedite submitting the charge sheet, then you could ask for the direction of the Magistrate in that respect or file a Revision Petition in High Court.

1. I agree with the expert advise of Mr. M. Bhadra, Advocate.
2. However, it is not your case, why are you so curious? What does his (accused's) lawyer say? Are you cross-checking his lawyer's version and strategy?
3. No such appointment is there in government as "night watch woman", re-check/ consult a local lawyer.

If you don't mind, your story seems to be hypothetical, as in any Government organisation night duty is prohibited unless that department works day & night for 24 hours a day.

Secondly, you have not given any description about and the present status of the investigation of the case of sexual harassment.

Thirdly, your query was not clear whether you desired information about departmental charge sheet or charge sheet in the court case. No department launches any court case directly unless investigated by an internal committee appointed in sexual harassment cases.

That clearly shows that you were not aware of the the full facts of the case. So, if Dr. J.C. Vashisht has pointed out about your no relation with the case, he has done nothing wrong. Your remarks against the views of Dr. Vashishta were, thus, quite unwarranted.
