Rti 2005 of sec. 8 (1) (j) denial of information

Under RTI 2005 - I applied to municipal authority to provide me the following information :

1) As per your inward record book I want the copies of only RTI letters submitted to your office by a person namely "Pritam" from yer. 2010 to till date.

reason for this RTI - to stop the misuse of RTI (blackmailing).


In reply of my this RTI the concerned officer replied that as per sec. 8 (1) (j) of RTI personal information cannot provided.

"Now to get such information what stand should i take to get such information."
Pl. guide me in this regard...

What are you planning to do after getting those copies of RTI applications? Is it required to file a PIL?

Section 8(1)(j) of RTI Act,2005 states as ”Notwithstanding anything contained in this act , there shall be no obligation to give any citizen information which relates to personal information the disclosure of which has no relationship to any public activity or interest , or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information officer or the State Public Information Officer or the appellate authority , as the case may be , is satisfied that the larger public interest justifies the disclosure of such information.”
(f) “information” means any material in any form, including records, documents, memos, e‑mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force;
the information sought by you is well covered under the definition of Information. The application made by the person Pritam is official record and may not be denied.
You may make an appeal to appellate authority named in reply. If appellate authority and its address is not mentioned in reply it is defective reply.

That person Pritam is using the rti as a tool to blackmail people's in the territory with the help of municipal officials... So i need the copies rti applications made by him to investigate some subspecies matters and to take appropriate action against him or such officials whose act might be malafide
Therefore I thought the info which I need is in wide public interest...

Sir,
The proper approach should have been a request to inspect copies of all RTI applications received at a particular department for a certain period.
The PIO could not have refused your RTI application under any pretext.

You feel that he is blackmailing you by RTI.

Each and every person whose wrong doings are exposed is aggrieved of RTI Act.

is he exposing some irregularity on your part.

if yes

then this is what the RTI Act is meant for.
