Rejoining psu which left over 3yrs

(Querist) 24 May 2017 This query is : Resolved
Sir I had left Bsnl after 12 yrs of service by giving simple resignation application .Bsnl approch me to complete formality but due to miscommunication .I didn't complete my formality.
But after left Bsnl I join some other regular job .now can I ask Bsnl to rejoin but Bsnl management hasitating to rejoin me .
So sir is it possible to rejoin Bsnl in legal circumstance.so what approch I should have to do .
Second I complete my resignation remaining formality .than is there any hurdle in financial benefit.

If they have not terminated or dismissed you so far as a penal action on disciplinary proceedings on account of unauthorised absence, you may still be on their rolls and can approach the BSNL to take you on duty. But still disciplinary action against you may not be far off to show you the door out of BSNL any time for remaining absent unauthorisedly for 3 years in continuation.

But, if you submitted formal resignation letter, forget about your wish fulfillment, as a day dream.

As opined by my learned colleague MrPS Dhingra please clarify as to the circumstances leading to your resignation.
If you have left on your own without any disciplinary action by bsnl, hou can rejoin the bsnl without any claim for past benefit or continuity of services for the purpose of retirement benefits.

Well advised by Mr.Dhingra and Dr. V. Gopinath. If your final settlement done based on resignation, no possibilities to claim employment. If final settlement not done, and no penal action against you, on your own interest complete the formalities and get settlement done. Resignation unless not rejected in writing it is deemed as accepted subject to completion of formalities as per rules in force for final settlement.
