Regarding employer sureity cheque

Respected Sir,
I have given a undated surity cheque to my company. If I have to leave job before the time limit of the company the company will deposit the cheque in bank.
At this stage what are the possibalites that I have in my hand.
please tell me what would happen if I apply in bank to cancel cheque payment.

You may show all related documents starting from.......Job advt,job application, interview call letter, selection letter, appointment letter, all rules/policies mentioned in appointment letter, standing orders (certified/model), service agreement/Bond,demand of security cheque and its acknowledgment etc to an able Labor Law Consultant/service Matters lawyer/Law Firm and give inputs in person.

Company can deposit the Cheque in the Bank after inserting date on the cheque and you have to face case u/s 138 NI Act.

Try to have amicable settlement with the company.

This question should have been posed at the time of giving undated cheque to your employer. Are you entertaining idea of leaving the present job? Why do want to go back on your word at this stage? As expert Shri Kumar Doab explained, do not jump into conclusions so easily, otherwise you will land into troubles and it would affect your career adversely.

The action of the company amounts to an abuse of Section 138 of the NI Act. No law is meant to be abused.
