Very vague query with confusing statement. If the grandfather had one son, who had two other sons and whether you are the son of the deceased son of grandfather or of any of the other two sons? You have to make the position clear.

Vijay Raj Mahajan (Expert) 26 September 2017
Both daughters havevone share each in the grandfather's property. You and other son of the son of the grandfather gets one share that would have gone to the deceased son. Total 3 parts of the property two parts goes to 2 daughter's and one part comes to heirs/sons of deceased son. There is no mention of the third daughter of the grandfather hence it will be presumed not living and left no legal heirs to claim her share.

Indeed very very vague, confusing, misleading and statement from one of the multiple fake ID’s of IT=@PSD to confuse and then post salute to another of multiple fake ID’s of IT=@PSD.

Why does the confused entity post at all and litter IT’s trademark nuisance daily at LCI.

Dear LCI querist Mr. vikram guvvala,
It is believed that you are all Hindu.
Is your grandfather alive?
The property even if minimal, of grandfather is self acquired/earned or ancestral?
What is this property; agricultural, rural/urban?
The daughters of grandfather are married/unmarried?
The property is in which state?

Confirm!

From your query it is felt that you are son of deceased son of your grandfather.

If per applicable succession laws the property of your Grandfather (Paternal) is to devolve then the deceased sons share shall devolve equally upon his ClassI legal heir’s i.e;
Mother (if alive as on date of his death), Wife (your mother; if alive as on date of his death…………….as per your post she has also deceased), sons and daughters……………
If your grandmother has pre-deceased your grandfather then NO share shall devolve upon her.
If your mother has pre-deceased your father then NO share shall devolve upon her.
If your mother has deceased after death of your father then equal share shall devolve upon her. Her share shall devolve equally upon her sons and daughters, since her husband has pre-deceased her.

If your paternal grandfather is alive and the property is self acquired in his hands then he can dispose it in anyone’s favor even a stranger in his life time by a valid/registered deed.
What is your and your brother’s age and what are you doing and do you have any biological sisters and are your sisters married?
Kumar Doab (Expert) 26 September 2017
Usually in such situations Grandparents do not discriminate and more so when the Only Son and his wife has died and have left grandsons and granddaughters without parents.

If alive, serve your grandfather with care and compassion and he may take care of your needs even if he has minimal property.
If he is not alive the inheritance has been explained, as per Hindu succession laws.

You have not mentioned when your grandparents expired. Who, when and how the property was purchased?

With the given facts agree with the expert Vijay Raj Mahajan.
