Property query

Hi,
My husband and his mother share the property of his father after his demise. We have a house in bangalore where we stay down and up house has been given for rent, the rent is been collected by the mother. They also have another property in bangalore where no contruction has been done. One more in Mangalore where there is 22 acres of commercial land where no construction has been done. My husband and I use to stay seperately in a rented house, after my father-in-laws death because of family pressure that she will have to stay alone we moved in with her. Once we moved in after a while, she started humiliating me and tocturing me, she also got my husband taken to the police station stating that he has abused her, but my husband was innocent, and the police was very cooperative and understood the situation. she usually fights with everyone even the police knows. she is 68 years old but wants to fight with each and everyone considering the garbabe people, bbmp, etc.. thats her nature. Now our only concern is we are scared to leave the house, because she has her brother's son living with us she might end up giving the property to him. is it possible, because we are frustrated living in that house, she does everything possible to trouble us and abuse us. what can be done from our end so that nothing of my husband goes to outsiders.

mother and son have equal share in the property on father demise . mother is free to bequeath her share in property as she pleases .

at most your husband can file suit for partition to claim his share in property

You have to bear and win confidence of your MIL if want to get her share of property.

Otherwise your husband has equal share in the property left by your FIL.
