My brother dies after 3 months of marriage but he does not have any kind of property on his name in such case can his wife make claim on my mother's fully own property

In case of Hindu male that deceases without disposing his estate/property by a valid/registered deed say; WILL, Gift..........the 1st right is of ClassI legal heirs i.e; Mother (if alive as on date of death), Wife (if alive as on date of death), sons, daughters................




If your father died without disposing his property in favor of your mother then your brother should have equal share, by inheritance.

If your brother did not dispose his share in his life time by a valid/registered deed in favor of your mother say; relinquishment then his wife can have share from his share.............



You may post how your father's property was transferred in the sole name of your mother!
