Mr. Sunil is a Dealer of Used Cars.
He purchases Second Hand Cars from Various non dealers and sells it to Consumers.
I want to know whether he is liable to VAT?on sales made?
If yes please guide me with the help of relevant provision in this context.

Sir,
I have already done that before asking on this forum.
But with due respect to the professionals, the local tax consultants failed to substantiate their replies.
Some said VAT leviable and some said not leviable. Even 1-2 person said that VAT leviable at 2%. but no one could support their views with reference to law.
Therefore i was bound to ask it here.
If I can get exact solution then it would be helpful.

Applicability of VAT for all the sales, is a state subject.
If the dealer issued a receipt for the amount paid including VAT then it can be deemed that he is liable to charge the same and remit it to the government. You may verify from Sales tax registration number about the VAT paid by him by filing a petition under RTI Act.
