Non-joinder of necessary parties

(Querist) 15 April 2013 This query is : Resolved 
An Appeal has been filed only by male members on behalf deceased applleants father. However, 2 Female members have not joined the Appeal. The property is also in the name of one female member. The high court has accepted the appeal.

is it a valid suit? what is the course of action for defendants during arguement? Can the High court dismiss case for non-joinder all necessary parties ?

no,Hc will not dismiss appeal but will ask

concerned party to file application for it.

There is no need to file appeal by all parties concerned.
