Money not returned (fraud)

Hii experts,
A agent of post office, takes my Rs. 50000 to invest in Kisan Vikas Patra before 3 months. But, he didn't invest my money in post office & use this amount for personal purpose.

I want to complaint against him.

Pls help me, in which IPC section, I should FIR against for that agent.. ??

Vague query.
You should be concerned with the police report. No section is required to be noted in the complaint. That is the headache of the police, under which section the case be booked.

Sorry... This is not my meaning. I want to know that can I complaint him in others authority like post office or Rbi grevience cell... ,! Which are good for me to get my money back ..?

You can approach Sub-Postmaster of PO where the said agent is attached and/or DSO…..

RBI is not regulator for PO.

Vague advice by Mr. Kumar Doab. Post Office cannot be the mediator between the querist and the agent.

Neither Post Office, nor RBI can help you. You were not supposed to give money to the agent, as he is not authorised to collect money for and on behalf of the P.O. This was your private dealing with the agent for your personal convenience.

lodge complaint against the person who take money and represent himself as an agent of the post office and consequently misappropriated money for his personal need, with the police station at locale, for FIR and investigation, into the matter of ur complaint, against the said agent or person.
the facts as placed by you disclose the facts of offenses committed to be punishable under Section 406 and 420 of the Indian Penal Code' 1860.
FIR in terms of Section 154 of the Criminal Procedure Code' 1973

Give complaint to the police as well as to Post office.

Strictly speaking he collected personal money from you and post office is not responsible to the same. However he approached you on the credibility of Post Office and Post office may not like to afford to keep on allowing him.

If that Person is Authorized Postal Savings Agent certainly the Postal Dept would take suitable action and your complaint would be protecting others also from them.Simultaneously a Police complaint also would serve your purpose.

Dear Mr. NJS Rajkumar,
No suitable action is warranted on the part of the Post Office. Nothing such happens as you think. You may like to know, Post Offices are neither the appointing authority, nor disciplinary authority of the Small Savings Agents. So, why to expect the Post Office to indulge in to the personal affairs and dealings between the individual and the agent?

Don't worry, the monthly or yearly quota of the agent would already have been covered, so he might have kept the money to utilise the same for the next assessment period to avoid his agency to be terminated.

But, still if you insist for lodge a complaint, nobody would entertain without the evidence in the shape of receipt granted by the agent in lieu of money received by him. I am sure, you may not be having any such receipt of money.

You can also try with leaders of Union (if one is there) and they may persuade the agent to refund the money to you…You may also consider involve community leaders/reputed persons and getting your money back ….
In future prefer to pay by a/c payee cheque….

Check with Sub Postmaster and DSO and you may find that such matters get resolved....
