Maintenance allowance

I am working in a PVT ltd company and earning 12000pm. My husband applied a divorce case. and I am applied a Maintenance allowance. and he wants to proove that I am working and earning. so he dont want to give any MA.while working cant i able to get MA from him. what will be MA eligibility as per indian law

if your are working you wont get maintenance .number of judgements that working wife is not entitled to maintenance

please mention what is your husband current income

Dear Querist
if you are able to maintain yourself then the court may not pass any maintenance order in your favor, but if your husband income is more then you and his life style is lavish then you may get maintenance as per his income and life style....

You have right to lead a life at par with your husband so if you have not equivalent income sources than your husband, even then you can demand.

Sir, withdrawal of the case can be a solution to my issues. he is drawing approximately 33k now. and he dont have any written proof that i am working. simply he created a resume of mine and showing that i am working.
I need the maintenance allowance for my life long. how to get that solution please.

If you are self dependant, don't try to live on charity, in case maintenance is not admissible to you in view of your own income. Try to live peaceful life. Don't try to hide your income. Even if you are able to conceal your income for the present, the same can be noticed by him any time later on account of which he can try you in the court of law for perjury also for lying before the court under oath, besides applying for recovery of the maintenance amount falsely claimed by you.
