Is it compulsaory to mention origin owner(previous owner)'s details in sale deed

Respected Sir,
Really I need ur suggestions….

My grandfather “Ramappa” purchased home of 63*63 sq feets and and an empty site of 45*300 sq. feet(two items) from a person named “yallappa” in 1975 in some “Grama panchayath”. When we bought that land, Yallappa mentioned that property as his “self owned property” and its measurement details along with neighbors land details in sale deed. But he didn’t mentioned his previous purchased details.

Whether is it compulsory to mention Yallapa his previous purchase or origin owner in his sale deed?

And also we build home 40*35 in empty site and paid tax till 1995 and took form-9 till that date. But later we didn’t paid tax for that land and also didn't took form 9.

Now some portion of land is empty in empty site and even we are in position in that land some other third person took form 9 for our empty portion site by submitting fake documents. And the Grama panchayath secretary saying they are original owner and also he rejected our application form when we go for paying tax and collecting form 9.

Now what we have to do ??

Better Consult a Local Good Advocate with all details and documents you possess along with up to date EC.

thank you for Raj kumar sir... we have that form EC dated 1972-75.. and can you plz tell me what is EC and where i have to apply for that??

At your Local Registrar Office which Covers the Concerned Plot you could Obtain Ec up to date which would reflect your sale deed also.

sir i collected previous sale deed of my property.. but in that boundary and measurements for empty site not mentioned exactly, i.e . they mentioned as "home and empty site" but boundary and measurement for home mentioned but not empty site...

The deed in which we purchased in that, boundary and measurement for both home and empty sites are there.

does previous deed is legally not correct??

You are having possession from more than 30 years and have documents of land, you have good case in your favour. Meet higher officials for orders to accept tax and issue form 9. In case of need consult local lawyer.

Does this land belonged to grama panchayat when your grandfather purchased?
How does Yallappa acquired the property and from whom?
Who was the initial owner/titleholder??? Show the document to a local lawyer for proper advise and guidence.

For a;l the practical purposes, the vendor has to very clearly state that how he acquired property and what is the proof of his title in the sale deed he executes in favor of the purchaser, without which, the sale deed executed by him will be redundant. You may consult a local lawyer with the relevant papers and take his opinion to all your queries.
