For Registration of Lease deed

Sir,

The period of the lease deed is over and lesor and lessee want to extend the further lease mutually by extending lock in period and lease rent.

Earlier lease deed was registered. Now for extension of this lease, we have to register this new lease deed before registrar or we can make one simple addendum and take a sign of both the parties.

Extension of Lease should be executed by both parties (lessor and lessee) and get it be registered with the terms and conditions of previous lease deed.

If further lease is for the period lesser than 11 months then it do not require registration but beyond that period, registration is mandatory.

Increase in lease deed need registration if more than the threshold / prescribed time exempting registration.

In exclusion of any extension clause in existing, lease deed needs to be registered.

1. A Lease Deed is "legally" effective "ONLY & ONLY" for the period specified in the Lease Deed, SUBSEQUENT to which the Lease Deed, lapses by "legal default".

2. The above is applicable in relation to Stamp Duty and Registration Fee. The Stamp Duty & Registration Fee, has also Lapsed & infructuous "by legal default", "AFTER" the period specified in the Lease Deed.

3. IF you "make one simple addendum and take a sign of both the parties", without payment of statutory taxes, THEN it would mean circumventing and cheating the law, as far as payment of Stamp Duty and Registration Fee, is concerned and further becomes a Criminal Offence, on both the parties.
