Difference between monthly & daily rated wages

Dear Sir(s),

What is the difference between MONTHLY rated wages and DAILY rated wages ?

If a worker's monthly wages is say 8000/- and in a particular month he is present for only 20 days, then we pay him 8000 / 26 * 20.

So, is this worker, DAILY rated or MONTHLY rated ?

Dear Sir (Sri S. Kumar):

My query is whether as per any labour law in India, any worker can be paid as "MONTHLY RATE OF WAGES" and / or "DAILY RATE OF WAGES" ?

In my earlier query I had given the actual position in case of a worker whose gross monthly wages is 8000/-. Now, in case, in a particular month, he works for only 20 days, so we pay him 6154/-.

So, legally, is this monthly rate of wages or daily rate of wages ?

Pls advise.

His salary will calculated in average of his monthly salary not as er daily wages.

Agreed,the average wages will be calculated on the basis of monthly wages.

Monthly salary can be calculated simply by dividing by the no. of days in particular month (30, 31 or 28/29) and then multiplying by no. of atendance + weekly offs; e.g. (8000/30)x 20=5333/=

The worker is monthly rated.

Calculate as; 8000/26*20
Add OT etc ..............if any!

If it is that the worker is actually worked for 20 days i.e. 20 working days ?
