Contract not extended without any prior notice

(Querist) 13 February 2016 This query is : Resolved
I have been working in iit guwahati as a project assistant since November 2011. My contract was till December 2015. But it was supposed to be renewed in january as our tenure is extended in every 3 months. All my project mates got extension letter through mail on 28/1/2016 except me. When i asked our pi (project in charge) about the same he just said that i will get extension but did mot say when. Then i gave him a written application asking for any updates regarding my extension. He didnot reply. Then i asked R&D section R&D section looks after everything related to projects in iitg). They also didnot reply to my mail. Now what should i do.

Refer to your job contract as both of you are bound by it,
The period of project work generally depends on the discretion of the employer though the life of employment is not.

Examine the contract for clause on notice.

Refer the terms and conditions of the contract.

In my contract it clearly mentioned that it is terminable by giving in writing one month's notice. But I was not given any kind of notice. I asked our HOC through a written application about it but he did not reply or should I say he was trying to ignore me. I asked the HOS R&D about the same through mail but again he did not reply as well. It seems like all of them are trying to play kind of mind games with me.

You should be eligible for atleast compensation in lieu of notice period.
Anirudh (Expert) 15 February 2016
One month's notice will be given to you only if within the period of contract, your services are terminated.

Now you say that your contract period of 3 months is already over. Therefore the question of any Notice does not arise.

The question of any compensation also does not arise, as there seems to be no breach of contract by IIT Guwahati.

Try to gently persuade the authorities concerned to take you again on contract basis.
Rupam dutta (Querist) 15 February 2016
yes I understand your point @Mr Anirudh. But the point is our HOC recommended my name for extension along with my project mates. I was told several times that my tenure will be extended I should continue my work as a project assistant in IITG.
Kumar Doab (Expert) 15 February 2016
As per your post based on recommendations and information available with HOC you were asked and allowed to work beyond contract.

Pursue with HOC and get extension.

If you are not overage try to be in permanent employment.
