Contract act 1872

(Querist) 23 November 2014 This query is : Resolved
Hi Der pls help me out in followin case.
'A' offers to sell his car to 'B' for $ 5000 through telephone. 'B' accepts for the same but in the mean time due to some technical error telephone lines got disconnected and 'A' unable to hear 'B; acceptance.
Can 'B' enforce it???
ROHIT SHARMA (Expert) 23 November 2014
1. Yes, B can enforce such oral contract. The proposal was made by A and B had accepted it. The disconnection is incidental and cannot come in way to negate the existence of the fact that the proposal was made by A and accepted by B.

With out any Documentary Evidences the Proposals can not be Enforced Legally basing on Oral Commitments.
