Hi Der pls help me out in followin case. 'A' offers to sell his car to 'B' for $ 5000 through telephone. 'B' accepts for the same but in the mean time due to some technical error telephone lines got disconnected and 'A' unable to hear 'B; acceptance. Can 'B' enforce it???

1. Yes, B can enforce such oral contract. The proposal was made by A and B had accepted it. The disconnection is incidental and cannot come in way to negate the existence of the fact that the proposal was made by A and accepted by B.

With out any Documentary Evidences the Proposals can not be Enforced Legally basing on Oral Commitments.

For reply to your academic question, you need to concentrate on your study aterial and Indian Contract Act.
