Combined property

(Querist) 11 November 2014 This query is : Resolved
Sir,
My father with my maternal uncle have purchased a residential property(G+3) with the investment ratio of 4:1 with verbal agreement that all the profits and losses will be shared in the same percentage. But my uncle with his smartness has got registered a larger Flat on his name and rest registered on my father, mother and my name. Now I am afraid that he may not bind to the verbal agreement. So, now I want to get a document prepared stating that no one has got the right to sell any portion individually. Is it possible to make in that way and Sir, if you can suggest any measure so that i can safeguard the total investment.

Thankyou sir

Dear,

If its registered in everyone's name, then he cannot sell it individually. How is th property, is it a flat or what?

Discuss/convience the matter with your mama and get a rectification deed registered.

Contact and engage a local lawyer and proceed.

Once the flats are registered on individual names, you cannot stop him from selling his property, but you all can sit together, discuss and settle the issues amicably and arrive at an agreement as per the resolution formed and proceed as per the terms of agreement.

Is there any other way out?
