Co-operative society bye laws

Hello:

I'm a resident of a Co-operative Society. And I wish to understand, am I supposed to take permission from the Society Committee to do any interiors of my flat such as painting, carpentry, or any other renovation work? Also, deposit an amount of Rs.2000/-. Is this all according to Bye Law No. 47.Could you please enlighten me. Thank you.

It shall be better to go through the bye-laws of your society as no comment can be made without going through that vital and sole document to reply your query.

Subject to Maharashtra:

1. Legally there is no need to take any permission for any non-structural repairs and renovations of interiors of a Flat, that is NOT-Owned by the Society.

2. HOWEVER, as a routine and as a force of long-standing habit, the Society insists on giving permission and taking a deposit, for any untoward expenditures that the Society might incur, due to any damages and spillage or other nuisances, that MAY be caused.

MODEL BYE – LAWS OF COOPERATIVE
HOUSING SOCIETY (proposed)
AS PER 97TH CONSTITUTIONAL AMENDMENT and
MAHARASHTRA CO-OP. SOCIETIES (AMENDMENT)






47. (a) No member shall, without the previous permission of
the Committee in writing, make any additions to or
alterations in his flat.

(b) The member, desirous of making any additions to or
alterations in his flat shall make an application to the
Secretary of the society, giving all the required
particulars. Further action on such application shall be
taken by the Secretary and the Committee of the
society as provided under the bye-law No. 65.

(c) No structural changes are permissible, without the
prior permission of the concerned Local Authority.
Such changes shall be done under the supervision of
the structural engineer from the panel of the local
authority.
