Captured by wife's activities through video recording

(Querist) 20 February 2017 This query is : Resolved
Hello again respected members.

while on one hand my wife said in court that she is unemployed, on the other hand she is running a clinic ( dental) in her dads property. the clinic is not registered.

I with the help of a private detective agency conducted a sting on my wife and in that video , she is treating a patient and taking cash against it.

Now is that video recording accepted in court as an evidence.i read an article by Mr Sethi on this same platform that video recording conducted without prior authority of a authorized body is not accepted in court. plz put some light as to what i can do when i have that video recording with me & if that is of any use or not

i saw the article on the same platform by Ajay sethi sir, but i could not understand it properly and specially in my case -- http://www.lawyersclubindia.com/experts/Electronic-record-evidence-admissibility-procedure-227731.asp

File an application before the court for seeking permission to submit such video by mentioning the necessity of filing such video as it is an important evidence and the necessity of recording the same secretly.

Thankyou for the reply Adv. Yogen sir. i am confused because Ajay sethi sir in his previous reply on this same platform mentioned that , video recording can only be done after geeting authority from a authorised body. else it is not accept as an evidence.. plz refer http://www.lawyersclubindia.com/experts/Electronic-record-evidence-admissibility-procedure-227731.asp

I am still firm on my opinion. No harm in asking for permission from the court. When there is non specific rule, then get the help of case laws.

Find out her registration no. with dental council.

Your lawyer can cross her to find out exact truth.

Meanwhile may move as advised by the expert.

Ty for reply again sir yogen usha madam and goyal sir. Yes i will follow the ablve mentioned advice and also discussed same with my lawyer. Also sir i managed to get a bank document where my wife just before filling the interim maintainence case, transfered 3 lakhs from her account to her fathers account and then closed her account. In maintainence case she said she is not able to maintain herself and also that her husband never spent a single penny on her. Now from where she got 3 lakhs and why she transferred her 3 lakhs to dad account and closed her account just before filling interim maintainence case . Can this help me
