Can a psu rate acr in a year as 'no acr'?

Dear Sir,

We are the employees of a PSU. One of my colleague was rated ‘below satisfactory’ in his annual confidential report(ACR) for the year 2014 because of his unauthorized absence in 2014 due to his illness as he has no leave on his credit at that time which will affect his promotion in future. Our PSU normally rates annual confidential report of an employee in four ways (outstanding, very good, good and below average) so far. Now it was established that my colleague was entitled special leave for the year 2014 for serious sickness as per company’s rule. But though our PSU management is going to sanction leave to him for serious sickness as per company’s rule but decides to rate his annual confidential report for the year 2014 as ‘no ACR’ (which will affect his promotion in future) with the reason that he didn’t perform any actual duty in the year 2014.

Sir, is there any provision of rating of any employee’s annual confidential report as ‘no ACR’ under service law in India in a PSU and when an employee didn’t perform any actual duty due to his illness(absence with authorized leave) can his ACR be rated as ‘no ACR’?
Pl guide us with reference of any rule in this regard.

It is a matter of commonsense, no work, no rating. The question arises, if the employee did not perform any duty during the year, for what type of performance he can get rating? Do you expect that he should be rated for his being absent on account of leave. Performance on duty is rated, not absence from duty.

Sir,

As I know as per Govt. rule there are four types ACRs as below:

APARs graded between 8 and 10 will be rated as ‘outstanding’
APARs graded between 6 and short-of 8 will be rated as ‘very good‘
APARs graded between 4 and short of 6 will be rated as ‘good’
APARs graded below 4 will be given a score of zero.
(DOPT OM No.21011/11/2010-Estt.A (Pt-II) dated 23.07.2009)

Many organizations also follow four types of APARs : Outstanding, Very Good, Good and Below satisfactory.

Sir, I want to know whether any organization can rate his employees' ACR other than the above four types of APAR as per its own policy or they should follow any standard practices like other PSUs or as per Govt. Rules.

Thanks for the information. But you have failed to reply my questions. I repeat my question other way, when there is no performance, what remains to be rated?

No ACR means no rating was possible for missing period of performance due to absence of the employee.

I would like to ask you a further question, would you like to be rated as zero in the absence of any performance?

You should know that zero rating is the worst rating as compared to the criteria of "No ACR." That can reduce average of all the five years in consideration, while "no ACR" has no impact on averaging of the ratings of all the years under consideration. You should feel lucky if "no ACR" has been mentioned in the ACR of the year, rather than zero rating.

Then it can be concluded that in this my 'no ACR" rating is completely different from 'below average ACR' rating as our company gives 'below average ACR' for unauthorized absence and colleague is not unauthorizedly absent as he entitled to leave for serious sickness as per our company rule.

No ACR means no ACR - it cannot be considered an adverse entry.

You are unduly stretching the thread. If you are so adament for rating, you can represent to the competent authority to rate that as zero for your satisfaction, so that the same may not be considered as "no ACR".
