Breach of contract terms..?

For a breach of contract terms (i.e not delivering or refuse to deliver the goods the goods ) can we prosecute the person U/S IPC 420 rather than prosecuting under civil law or contract act..?

you can file civil as well as criminal case . if the ingredients of section 420 are satisfied you can file case of cheating

Both cases can be filed, consult local lawyer an show him all the documents.

It depends on the contract terms and agreements. As observed by experts, if it satisfies the ingredients of criminal offence attracting provisions section 420 of IPC, you may consult your lawyer and proceed.
