Bonus

Hi

I resigned through company email when I was on vacation.However company did not accept my resignation and denied providing me relieving letter,experience certificate etc.
They also did not give my Diwali bonus.
So what legal actions can I take against the company

It is general habit of private employers to harass the outgoing employees and stop some of their benefits for one excuse or the other.

You should have sent written resignation letter in continuation and confirmation of the email.

Now send registered letter with weekly reminders for your benefits.

Do you have copy of notice/resignation sent by you?
Has company declined to accept in writing?

Have you written to establishment; good offices of appointing authority/MD/CEO, under proper acknowledgment so far?

If yes what is the reply of establishment?

Well advised by experts, I agree.
Send a hard copy of resignation demanding acceptance and experience certificate and outstanding amount. If it is still not considered issue legal notice followed by filing a case.

What is its nature of business say; IT, ITeS?
How many persons are employed in it?
What is your designation and nature of duties?
How many persons report to you?

Do standing orders (model/certified) apply to establishment and your designation? ( Apparently NO)

Was ever any stinker, memo, show cause notice on any misconduct issued to you?
Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?
Are you a member of employee’s/trade unions?
Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?
