How can I break my 2 years bond without paying
Adv Akhtar Ali Sheikh (Expert) 21 May 2016
You can't unless there is any lapse from other side. You may try ignoring, in case they do not initiate any action you will be saved.

If the tenure in so called Bond is completed, then what is the issue?

You should feel liberated from the T&C of the so called Bond?

The original certificates can not be retained by employer leave apart by another employee like you i.e. HR!

Even employer can not have any lien on your original certificates?

Has the employer issued any communication in writing asking you to deposit original certificates..............did it mention reason for it also................and did it issue acknowledgment of having received the original certificates?

Have you asked in writing, the employer or signatory that issued acknowledgment, to return your original certificates?

The Bond was created in lieu of what extra ordinary benefit by employer?

What is your designation and nature of duties as per appointment letter and in practice?

Yes, the employer has no lien over your certificates which belong to you. An the bond, they cannot enforce unilaterally.
Rajendra K Goyal (Expert) 21 May 2016
Send registered letter / request duly acknowledged to return your originals.

There are many threads on similar queries at LCI alone.

A sensible person/employee until or unless having a reason won't join with such harsh/penultimate conditions.

Or the person/employee would be ill informed.

The unscrupulous employers are prowling to have person under such Bonds and such conditions.

It is understood that you have a situation!

Such situations are to be handled carefully so that employee can escape without any adverse effect.

It is suggested that you may reply pointwise to all points and refrain from proceeding on your own and proceed under the expert advise of an able counsel and keep elders of the family by your side.

T. Kalaiselvan, Advocate (Expert) 24 May 2016
If you are on the right side then what is your worry about.
If the employer is not returning the certificates, you may issue a legal notice demanding your certificates, failing to respond or comply with the demand you may drag him to court of law seeking justice, relief and also compensations for mental harassment too.
