The author does not whether the person has bequeathed Will or not.
It is purely academic query.

what basis you say property is ancestral?
Arka Foundation (Querist) 31 August 2014
dear forum,

there is nothing academic query.

it is not self-earned by the old woman.

It has come to her through her husbands family (again not from husband self-earned)

LOTS OF ACADEMIC QUERIES BY YOU !!
Ask legal personal problem only...
T. Kalaiselvan, Advocate (Expert) 04 September 2014
1) No;
2) the property will be divided equally by all legal heirs.
However the query appears to be academic in nature.
