Hi,
Please provide some more clarity on below points.
1. If a Muslim man is already married under Nikah and wants to marry another woman under Special Marriage Act is this permissible and if Yes then is it permissible without divorcing the first wife legally?
2. If this Muslim man approaches the court for special marriage act to get married for the second time then what should be his marital status which is to be declared in the affidavit Married or Bachelor?
3. If this Muslim Man declares himself as Married will the second marriage commence through the special marriage act?
4. If this Muslim Man declares himself as Bachelor will the second marriage commence through the special marriage act?
5.Last but not the least what are the consequences if this Muslim man describes himself as Bachelor and submits the application to file under Special Marriage Act.

Your 4th and 5th Query could land you in criminal Offence.A Legal second marriage could be done only after getting divorce from first marriage.Once A man gets married he is no more a Bachelor.Either he could be called as married man and if he gets divorce he would be only divorcee and not bachelor.
