bifurcate the property legally

Hi Team,

I am Kumar. Need a suggestion on my grand ma property.

My GrandMother had wrote a will to divide her property to all 8 parts and 2 parts to be given to one of her daughter and remaining 6 parts to be divided by other children. Unfortunately in the will its not mentioned who owns which part. As my one of my aunt (my fathers younger sister who owns 2 share) and uncle (my fathers younger brother) were in financial problems, my dad has purchased their share by giving them money via release deed. Now we own 4 shares (my aunts 2 share + 1 share of my uncle + 1 share of my dad) . my other uncles and aunts are giving trouble and they are not letting us to own half of the property what we have. I would like to bifurcate the property legally. Please suggest what needs to be done. Thanks a lot in advance!!!

Bifurcation of the property is an issue that should be worked out amicable between all. You may either take services of outside Mediator or Arbitrator in this regard or move application to Lok Adalat of the District Court to resolve the issue between all the members of the family.

Thank you for your suggestion sir. Those people (uncle/aunts) are demanding for some money and they are asking us not to construct house for next 5 years after the purchase is done. Is it better to fight legally or settle the issue by giving them money and agree to their conditions.

You may buy their share of the property to settle the issue amicably.

You may either enter into registered family agreement with WILL, release deed ,boundaries narrated in it..amicably and end the dispute.
Or buy rest of the share and end the dispute..
If you are unable to resolve on your own take help of a very able senior LOCAL counsel of unshakable repute and integrity specializing in testamentary/civil matters and having successful track record and worth his/her salt….to mediate, arbitrate and end the dispute outside court
Or approach court…under expert counsel …
