Dear Vijay Anand Sahab, Who said it the it is General Proposition. The title of the post is Six months period is not mandatory in MCD cases SC Judgement, So read properly and do as you think fit, as per my opinion The title is right and don't say these type of the word that it is wrong, it may be wrong as per your opinion but not in my, so please don't choose your word unprofessionally. I am not mis leading anybody, It is my own Interpretation read the judgements and another post carefully and if you think that this information or judgement is useful for you then use it with your own wish and will.

Practically of no use as its granted in exceptional cases. Cost increases exponentially & time lag at SC is tremendous

It is wrong to say that "Six months period is not mandatory in MCD cases" as stated by you. It is not a General Proposition. It applies to that particular case only that too, the supreme court of india is invoking its inherent power under Article 142 and waive the six months cooling period by it. Hence no other Court in India has any power to exempt or waive the six months cooling period in MCD Cases. The Reporter of this case has wrongly miscontrued and wrote it as if it is applicable to all cases and can be applied by all Courts in India.
