IT ACT AMMENDMENT BILL: LOK SABHA PASSES THE BILL 23-12-2008 11:19:10 IST The lower house of the Indian Parliament, Lok Sabha passed the Information Technology (Amendment) Bill, 2006 on December 22. The Bill added new provisions to the existing Information Technology Act, 2000 to deal with new forms of cyber crimes like publicising sexually explicit material in electronic form, video voyeurism and breach of confidentiality and leakage of data by intermediary and e-commerce frauds. The amended IT bill says that if any individual publishes and transmits obscene material in electronic form he/she will have to face legal prosecution. A Cyber Appellate Tribunal has been proposed in the bill. According to the Bill, the Central government will decide the number of members of the tribunal later. The amended Bill also gives the Central government powers to issue directives for intercepting, monitoring or decryption of any information through computer. As per the amended IT Bill, the government has the power to intercept computer communication in any investigation. Only in case of national interest the telephones and letters may be intercepted. The new IT Act did not mentioned anything about the procedure of collecting personal information. Apart this, the Bill provides compensation for unlawful loss or gain arising from unauthorised use of data but it does not address the issue of breach of privacy.
